General Terms and Conditions

Article 1 – Definitions
For the purposes of these Terms and Conditions, the following definitions apply:

  1. Return Period: The period within which the consumer may exercise their right to a return for change of mind, as defined by Australian Consumer Law.

  2. Consumer: A natural person (an individual) acquiring goods wholly or predominantly for personal, domestic, or household use or consumption.

  3. Business Day: A day that is not a Saturday, Sunday, or public holiday in New South Wales, Australia.

  4. Contract for a Definite Period: A contract providing for the regular delivery of goods over a defined period (e.g., a subscription).

  5. Durable Medium: Any instrument which enables the recipient to store information addressed personally to them in a way accessible for future reference for a period of time adequate for the purposes of the information.

  6. Consumer Guarantees: The non-excludable statutory rights and remedies provided to consumers under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)).

  7. Entrepreneur / Seller: Judy’s Boutique Pty Ltd (ABN: [Your ABN Here]), trading as Judy’s Boutique.

  8. Distance Contract: A contract concluded between the seller and the consumer without the simultaneous physical presence of the parties, using one or more means of distance communication (e.g., the online store).

  9. General Terms and Conditions: The present terms and conditions.

Article 2 – Applicability

  1. These General Terms and Conditions apply to every offer made by the seller and to every distance contract concluded between the seller and the consumer.

  2. Before the contract is concluded, the text of these General Terms and Conditions will be made available to the consumer electronically via the website. If this is not reasonably possible, the seller will indicate how the terms can be accessed free of charge before the contract is concluded.

  3. These terms are subject to the non-excludable consumer guarantees under Australian Consumer Law, which prevail to the extent of any inconsistency.

Article 3 – The Offer

  1. If an offer has a limited period of validity or is subject to conditions, this will be explicitly stated in the offer.

  2. The offer contains a complete and accurate description of the goods offered. Descriptions, images, and specifications are for guidance only; minor deviations do not constitute a fault.

  3. Obvious errors or mistakes in the offer are not binding on the seller.

Article 4 – The Contract

  1. The contract is concluded at the moment the consumer accepts the offer and completes the payment process under the conditions set.

  2. The seller will promptly send an electronic order confirmation. The consumer may cancel the order within 60 minutes of placement by contacting customer service, after which the order enters processing.

  3. The seller takes appropriate technical and organisational measures to secure electronic data transfer.

Article 5 – Returns & Change of Mind

  1. The consumer has the right to return products for change of mind within 30 days of receipt, provided the goods are in new, unused, and saleable condition with original tags and packaging.

  2. To initiate a return, the consumer must notify the seller via info@judysboutique.com within this period.

  3. The consumer is responsible for the cost of returning the goods for change-of-mind returns.

  4. The seller will process the refund to the original payment method within 5 business days of receiving the returned goods and confirming their condition.

  5. This right does not apply to goods that are personalised, or to items excluded for hygiene reasons (e.g., swimwear, underwear), unless faulty.

Article 6 – Consumer Guarantees (Faulty Goods)

  1. The seller guarantees that all goods supplied come with the non-excludable consumer guarantees under Australian Consumer Law, including that goods are of acceptable quality, fit for purpose, and match their description.

  2. If a product is faulty, not as described, or does not do what it is supposed to do, the consumer is entitled to a remedy, which may include a repair, replacement, or refund.

  3. For faulty goods, the seller will cover the cost of the return and the remedy. The consumer must notify the seller of the fault via info@judysboutique.com

Article 7 – Prices & Payment

  1. All prices are in Australian Dollars (AUD) and include Goods and Services Tax (GST) where applicable.

  2. The total purchase price, including any delivery charges, will be displayed before the consumer confirms the order.

  3. Payment is due at the time of order. The seller accepts major credit/debit cards and other payment methods as indicated on the website.

  4. The seller reserves the right to correct any pricing errors. If an incorrect price was charged, the seller will notify the consumer and either cancel the order or provide the option to pay the correct price.

Article 8 – Delivery

  1. The seller will deliver goods to the address specified by the consumer in Australia.

  2. Estimated delivery times are provided on the website and in order confirmations but are estimates only. The seller is not liable for delays outside its reasonable control.

  3. Risk in the goods passes to the consumer upon delivery.

Article 9 – Complaints & Disputes

  1. Complaints about the execution of the contract must be submitted fully and clearly to info@judysboutique.com within a reasonable time.

  2. The seller will respond to complaints within a reasonable period, typically within 5 business days.

  3. If a complaint cannot be resolved directly, the consumer may refer the matter to the relevant Australian consumer protection authority.

Article 10 – Limitation of Liability

  1. The seller’s liability for any breach of a consumer guarantee is limited to the remedies available under Australian Consumer Law.

  2. To the fullest extent permitted by law, the seller is not liable for any indirect, incidental, or consequential loss or damage.

Article 12 – Governing Law
These General Terms and Conditions and all agreements arising therefrom are governed by the laws of New South Wales, Australia. Any disputes are subject to the non-exclusive jurisdiction of the courts of New South Wales.
